P&ID v. FGN — $11bn Award

Process & Industrial Developments Ltd obtained a 2017 arbitral award of $6.6bn plus interest (≈ $11bn by 2023) against Nigeria for an aborted 2010 Gas Supply & Processing Agreement. On 23 October 2023 the English Commercial Court (Knowles J., [2023] EWHC 2638 (Comm)) set the award aside, finding it was procured by fraud and bribery — Nigeria's largest-ever litigation reversal.

Process & Industrial Developments Ltd (P&ID) — an Irish shell company — secured a 2017 LCIA arbitral award of $6.6bn plus interest (rising to ~$11bn by 2023) over an aborted 2010 Gas Supply and Processing Agreement with the Ministry of Petroleum Resources. Nigeria challenged the award. On 23 October 2023 the Commercial Court in London (Knowles J., FRN v. Process & Industrial Developments Ltd [2023] EWHC 2638 (Comm)) set the award aside in full, holding it was procured by fraud, perjury and continuous bribery of Nigerian officials during both the contract and arbitration. The Mr Justice Knowles judgment runs 140 pages and is one of the most detailed forensic anti-corruption rulings ever handed down by an English court.
