Electoral2022Fourth Republic (Buhari II)· Act No. 13, 2022

Electoral Act, 2022

Legal basis for BVAS, IReV, electronic transmission of results, early release of campaign funds, primary-election timelines.

Signed 25 February 2022 after multiple withholdings of presidential assent. §47 codifies smart-card readers and the Bimodal Voter Accreditation System (BVAS). §50(2) permits electronic transmission of results to the INEC Result Viewing portal (IReV). §84 sets timeframes for primary elections. Tested in the 2023 general election with deeply contested results; the Supreme Court in PDP v. INEC (2023) held that real-time transmission was not strictly mandatory.
