Establishment of the office of President
There shall be for the Federation a President. The President shall be the Head of State, the Chief Executive of the Federation and Commander-in-Chief of the Armed Forces of the Federation.

Qualification for election as President
A person shall be qualified for election to the office of the President if he is a citizen of Nigeria by birth; he has attained the age of thirty-five years; he is a member of a political party and is sponsored by that political party; he has been educated up to at least School Certificate level or its equivalent.

An election to the office of President shall be held on a date to be appointed by the Independent National Electoral Commission. An election shall be held not earlier than one hundred and fifty days and not later than thirty days before the expiration of the term of office of the last holder of that office.

Tenure of office of President
Subject to the provisions of this Constitution, a person shall hold the office of President until when his successor in office takes the oath of that office; he dies whilst holding such office; the date when his resignation from office takes effect; or he otherwise ceases to hold office in accordance with the provisions of this Constitution.

Permanent incapacity of President or Vice-President
The President or Vice-President shall cease to hold office, if by a resolution passed by two-thirds majority of all the members of the executive council of the Federation, it is declared that the President or Vice-President is incapable of discharging the functions of his office; and the declaration is verified, after such medical examination as may be necessary, by a medical panel established under subsection (4) of this section.

Appointment of Ministers of the FederationAmended · 1
There shall be such offices of Ministers of the Government of the Federation as may be established by the President. Any appointment to the office of Minister of the Government of the Federation shall, if the nomination of any person to such office is confirmed by the Senate, be made by the President.
